% 14.03.2016 Learned senior counsel for the petitioner submits that possession of the suit has since been taken over by the landlord on 05.03.2015 in the execution proceedings. It has been pointed out that the petitioner whose defence is that he is the owner of half of the property by virtue of agreement to sell has filed a separate suit for partition. Any observation made in the impugned order will not effect the rights of the parties.

Petition not pressed and the same is disposed of in the above terms.
