% 07.02.2018 None appears for the respondent No.2 even on the second call. Learned counsel for the petitioners states that since the trial is at the fag end and only three witnesses remains to be examined and the petitioners would lead their defence to show that they were not present at the spot as was Tejji Gujjar, who was not charge-sheeted as an accused and no cognizance was taken by the learned Trial Court though named in the FIR, he be permitted to withdraw the present petition with liberty to take all the pleas before the learned Trial Court.

Leave and liberty granted. Petition and application are dismissed as withdrawn.
