% 02.06.2016 I.A. No.7324/2016 (under Order 23 Rule 3 CPC) and CS(OS) No.2704/2011 and CC No.5/2013 1.

By this application (I.A. No.7324/2016) under Order 23 Rule 3 of Code of Civil Procedure, 1908 (CPC) the disputes between the parties in the form of the suit and counter claim are said to have been settled whereby in full and final settlement of the respective claims in the suit and the counter claim, the defendant no.2 will be paid a sum of Rs.2 lacs by the plaintiffs and which has been done in terms of a cheque handed over in the Court today as detailed in para 2 of the application. CS(OS) No.2704/2011

Suit is accordingly withdrawn inasmuch as no reliefs are claimed against the defendants and the defendant no.2 has received the aforesaid amount of Rs.2 lacs in full and final settlement with respect to the counter claim filed.

Suit and the counter claim are accordingly disposed of as compromised.

I.A. is also accordingly disposed of.
