% 28.02.2020 IA 2851/2020 This joint application has been filed by the plaintiff and by the defendant nos. 1, 2 and 3 under Order XXIII Rule 3 read with Section CPC with the following prayers:
"In view of the aforesaid facts and circumstances of the case, it is most respectfully prayed that this Hon'ble Court may kindly be pleased to decree the suit of the Plaintiff in terms of the settlement so arrived at between the parties. And/or pass any other or further order, which this Hon'ble Court may deem fit and proper in the facts and circumstances of this case."
The application is accompanied by the affidavits of the parties. Learned counsel for the parties state that the parties have settled their inter
se disputes in terms of the averments made in the application. They also state that the parties shall be bound by the terms of settlement as reflected in this application and the suit be decreed in terms thereof. Accordingly, by taking the submissions on record the suit is decreed and the terms of settlement shall form part of the decree. Decree sheet be drawn accordingly.
Application stands disposed of.
Pending Chamber Appeal and the application, if any, have become infructuous and disposed of as such.
