W.P.(C) 6866/2018 & CM No. 26074/2018 (interim direction) Mr. F.K. Jha, learned counsel appearing on behalf of the petitioner states that without prejudice to his rights and contentions that the respondent No. 1/School is not entitled to recover school fee from his client, without complying with the mandate of the Delhi School Education Act & Rules, 1973 (DSEAR), they will deposit the fee demanded by the latter under protest forthwith.

The undertaking made on behalf of the petitioner is hereby accepted. W.P.(C) 6866/2018

Learned counsel for the petitioner further states that the issue raised in the present petition be referred to the Directorate of Education (DOE) for action, in accordance with law.

Issue notice.

Mr. Sanjoy Ghose, learned Additional Standing Counsel appearing on behalf of the GNCTD accepts notice. Ms. Eshita Baruah, learned counsel appearing on behalf of the respondent No. 3 accepts notice. Mr. Sanjoy Ghose, learned ASG for the GNCTD states that they shall treat the present petition and its annexures as a representation and determine it expeditiously, after affording a reasonable opportunity of hearing to the petitioner, in accordance with law.

With the above direction, the writ petition is disposed of. Pending application also stands disposed of.
