This is an application moved on behalf of the appellant praying for refund of excess Court fee paid in the appeal. 2.

Proxy counsel for the appellant is present and submits that main counsel is indisposed of.

As per the office report, the Court fee payable in this appeal as per the calculation done by the Registry is ₹59400/-. The appellant initially paid ₹22,620/- towards Court fee. Thereafter, the appellant after seeking extension of time to pay the balance Court fee, paid ₹37,795/- and total Court fee paid by the appellant comes to ₹60415/-. Thus, the appellant has paid ₹1015/- as excess Court fee.

The excess Court fee of ₹1015/- be refunded to the appellant as per rules.

The application stands disposed of.

As prayed, copy of the order be given dasti to learned counsel for the appellant.
