% 14.07.2017 C.M. No.44564/2016 (for clarification of order dated 08.3.2016) Petitioner is seeking a clarification of the order dated 08.3.2016. His submission is that the Trial Court after receipt of the aforenoted noted did not consider the submission of the petitioner which submission was to the effect that the land in question is agricultural land. He has drawn attention of this Court to the order passed by the Civil Judge on 27.10.2016. In this order the learned Court had noted the submission made by learned counsel for petitioner/defendant nos.1 and 2 that he would seek clarification of the order passed by this Court on 08.3.2017.

The order dated 08.3.2017 is self-clarificatory. The Court had noted that the earlier order passed by the Trial Court dated 13.8.2009 had decided the preliminary issue returning a finding that the suit pending before the Trial Court was not barred nevertheless the

petitioner had been granted opportunity to make his submissions qua the nature of the suit and the submission of the petitioner having been noted that the land is agricultural land. These submissions, in the light of the said order be considered by the Trial Court. Application disposed of.
