O R D E R

% 13.09.2025 Appellant insurance company has filed an appeal for reduction of the award dated 10.04.2013 passed by the Learned MACT, awarding a compensation of Rs. 20,85,384/- along with interest @ 7.5% p.a. from the date of filing of claim petition. On appeal, the insurance company deposited entire awarded amount with up to date interest in terms of the order dated 30.10.2013 passed by this Hon'ble Court was deposited before the Registrar General of this Court and 70% of the awarded amount was released to R-1 and 2 in term of the award of the tribunal. We have interacted with the learned counsel/parties concerned. amount along with accrued interest, lump sum amount of Rs. 4,90,000/- be refunded to the Appellant insurance company and balance amount lying deposited before the Ld. Registrar General of the Hon'ble High Court along with the total interest be released to the Respondent No. 1 and 2.

Learned counsel for the respondent submits that the balance amount lying before the concerned Tribunal along with accrued interest be released to the respondent (s)/claimant(s). In terms thereof, Ld. Registrar General is directed to refund a sum of Rs. 4,90,000/- to the Appellant Insurance Company and release the balance amount lying deposited before the Ld. Registrar General along with total interest to the Respondent(s)/Claimant(s) as per the proportions of the award subject to compliance of all the requisite formalities. Needless to say that appellant shall be entitled to refund of statutory amount along with interest, if any. In terms of the aforesaid, the present appeal along with pending application (s) stand disposed of with directions in terms of the settlement.

A copy of this order be sent to the concerned learned Tribunal with TCR, if already received.
