% 17.09.2018 Learned counsel for the petitioner submits that allegation of rape is not alleged against the petitioner in the FIR and even in the statement under Section 164 Cr.P.C.
Learned APP on instructions of the Investigating Officer, SI Seema Bharti has not disputed this position. Petitioner has already joined investigation. The main accused is already on bail. Keeping in mind the totality of facts and circumstances of this case, it is ordered that in case of arrest, petitioner be released on bail subject to his furnishing a personal bond in the sum of `10,000/-(Rupees Ten Thousand Only) with one surety of the like amount to the satisfaction of the Investigating Officer/Arresting Officer/SHO concerned. However, petitioner
shall cooperate in the investigation and appear before the Investigating Officer as and when he is called upon to do so. Bail application is disposed of in the above terms. Dasti.
