O R D E R

% 05.10.2016 The learned counsel for respondent No.1 submits that though the order dated 17.05.2016 of removing the petitioner from service has been withdrawn, however, pending the approval of the Directorate of Education, the petitioner is now being treated under suspension. He submits that pending the aforesaid approval, the petitioner has been paid 50% of his salary as subsistence allowance from the date of the termination of his service.

The receipt of the said monies is acknowledged by the learned counsel for the petitioner.

The learned counsel for respondent No.1 further submits that till such approval is granted by the Directorate of Education, the petitioner shall continue to be paid 50% of his salary as subsistence allowance. In the circumstances, the writ petition has become infructuous.

Accordingly, the petition alongwith pending applications is dismissed as having become infructuous.

The petitioner's right to assail any precipitate order before the appropriate forum shall not be prejudiced.
