% 07.10.2016 IA No. 12656/2016 in CS(OS) 2260/2013 Defendant has filed application for summoning of witnesses mentioned in schedule of witnesses.

Ld. counsel for plaintiff has objected to summoning of the witness at Sl. No.2 in the Schedule of Witnesses on the ground that this witness has already been examined, cross-examined and discharged. I have perused the schedule as testimony of the witness. Defendant is summoning the official from the office of the SubRegistrar alongwith the original WILL for proving the signatures of the attesting witness on the WILL and for this purpose defendant has sighted the attesting witness at Sl. No.1. DW-2 when appeared earlier had not produced the original WILL and for this reason the copy of the WILL was marked as Mark D2. Even otherwise, the attesting witness is required to be shown the

original document for identifying his signatures. Registry is directed to issue summons to the witnesses mentioned in Schedule of Witnesses filed alongwith the application on filing of PF for 19th October, 2016, the date already fixed. The diet money shall be paid to the witnesses at the spot. The witnesses shall appear before the Ld. Local Commissioner on 19th and 26th October, 2016 at 11:00 AM alongwith the summoned records at the office of Delhi High Court Bar Association, High Court of Delhi, New Delhi.
