% 06.07.2015 The petitioner challenges the framing of charge under Section 411 against him vide order dated 9.5.2013 passed by the Court below. Submission on behalf of the petitioner is that no offence under Section 411 of the IPC can at all be said to have been made out even if the allegations in the case and the chargesheet are accepted to be ex facie true. Mr. M.P. Singh, learned Additional Public Prosecutor submits that out of 20 witnesses, many witnesses have been examined by now. In fact the complainant of the case also has been examined and has been discharged. Considering the fact that the trial has proceeded, this Court is not inclined to interfere with the order framing charges.
