Faced with the point that the petitioner has been transferred from the 28th Battalion to the 42nd Battalion, ITBP stationed currently at Jodhpur (a soft station), learned counsel for the petitioner states that the writ petition may be disposed of with a direction that the representation made by the petitioner (Annexure P-3) be decided by the competent authority within four weeks.

Requiring the petitioner to join the 42nd Battalion and for which we grant petitioner four days' time to do so, the writ petition is disposed of directing the competent authority to treat instant writ petition as a W.P.(C) 5779/2016

representation and take a decision whether the petitioner should be posted back to Delhi for being medically monitored with respect to the eye and heart ailment which petitioner suffers from.

Decision shall be conveyed to the petitioner within four week from today.
