This petition under Section 25-B(8) of the Delhi Rent Control Act, 1958 has been preferred by the landlord impugning the order dated 5th March, 2016 of the Rent Controller (South), Saket Courts, New Delhi granting to the respondents leave to defend the petition for eviction under Section 14(1)(e) of the Act by the petitioner for eviction of the respondents from Shop No.4 in property No.67B, Ground Floor, Main Market Garhi, East of Kailash, New Delhi.

The petition was entertained and notice thereof issued. 3.

Today none has appears for the respondents.

One gentleman claiming to be Mr. Vijay Kumar, husband of the petitioner Mrs. Babita, has handed over in the Court a copy of the order dated 3rd April, 2017 of ACJ/CCJ/ARC-(SE), Saket Courts, New Delhi during the Pre Lok Adalat Sitting and which order is taken on record RC.REV. 322/2016

and states that in terms of the settlement arrived at by the petitioner with the respondents, the respondents have already vacated the premises and delivered possession to the petitioner Mrs. Babita. He states that in view of the said settlement, the eviction petition has also since been disposed of. 5.

The said Mr. Vijay Kumar, on asking, has furnished his Aadhaar Card and photocopy of which in proof of his identity has been taken by the Court Master and be kept on record.

In view of the aforesaid, the petition is disposed of as settled. RAJIV SAHAI ENDLAW, J.
