% 02.06.2016 This is a petition u/s 482 Cr.P.C. moved by the petitioners for quashing of FIR No.222/2015 registered at Police Station Sagarpur, Delhi under Ss.354/354A/323/34 IPC and consequent proceedings emanating therefrom on the ground that the parties have compromised the matter.
It is submitted by counsel for the petitioners that the petitioner no.1 is the husband of the respondent no.2 while the petitioner no.2 is her brother in law. The matter was settled before the Mediation Centre, Patiala House Courts, New Delhi pursuant to which the respondent no.2 has started living with the petitioner no.1 and they have been living together happily for the last about six months. Since as per the settlement, the parties are living together for the last six months, this petition has been filed for quashing the instant FIR. It is further submitted that another FIR No.223/2015 has been quashed today. As such, it is prayed that the instant FIR be also quashed. The respondent No.2/complainant, who is present in person (duly identified by her counsel) submits that she has amicably resolved all disputes with the petitioners.
She has been living with the petitioner no.1 for the last six months happily. She further states that since she has settled the matter with the petitioners voluntarily without there being any threat, coercion or pressure of any sort and in view of the settlement arrived at between the parties, she does not want any action against the petitioners and has no objection to quashing of the instant FIR. Ms Richa Kapoor, ASC for State, who appears on advance notice, submits that in view of the settlement arrived at between the parties, she has no objection to quashing of FIR.
amicably and the fact that the petitioner no.1 and the respondent no.2 are living happily with each other for the last about 6 months, this matter deserves to be given a quietus as continuance of proceedings arising out of the FIR in question would be an exercise in futility and wastage of precious time of the Court.
Accordingly, the petition is allowed and the FIR No.222/2015 registered at Police Station Sagarpur, Delhi under Ss.354/354A/323/34 IPC and consequent proceedings emanating therefrom are hereby quashed.
The petition stands disposed of accordingly.
