TR.P.(C.) 116/2018 Vide the present transfer petition, the petitioner seeks the transfer of two Eviction Petitions, i.e., Eviction Petition bearing No.25/2015 (New No.745/16) and Eviction Petition bearing No.E160/2013 (New No.25/2016) on the ground of sub-letting from the Court of the learned ARC, East, KKD, Delhi to the Court of learned ARC, District Shahdara.

Apart from various other submissions that have been made through the petition, there is reliance placed on the proceedings dated 06.06.2018 of the RCT East, i.e., the Court of the District & Sessions Judge, East observing to the effect that the tenanted premises in question were situated in the territorial jurisdiction of the District

Shahdara and as a consequence thereof, the proceedings of RCT No.15/18 were taken up by this Court on 06.07.2018 qua TR.P. (C)113/2018 and vide order dated 06.07.2018, the proceedings of RCT No. 15/18 were thus transferred to the learned RCT, Shahdara and directed to be placed before the learned RCT Shahdara for the date 16.07.2018.

The premises described in the order dated 06.07.2018 in TR.P. (C)113/2018 as A-4/4, Main Road, Krishna Nagar, Delhi are also as detailed in the present transfer petition bearing no. TR.P. (C)116/2018. In view thereof, the proceedings of Eviction Petition No. 25/15 (New No.745/16) and Eviction Petition bearing No.E160/2013 (New No.25/2016) presently pending before the ARC East, KKD Courts, Delhi are withdrawn from the said learned Court and are directed to be placed before the learned RCT, Shahdara, i.e., the Court of the District & Sessions Judge, Shahdara to be assigned to the ARC Shahdara for the date 13.08.2018 at 2.30 PM.

The petition is disposed of accordingly.

Copy of this order be sent to the learned District & Sessions Judge, Shahdara and be also served by the Registry on the respondent. ANU MALHOTRA, J AUGUST 09, 2018/NC
