% 27.11.2018 The Court would note that the petition was earlier dismissed in default and for non-prosecution on 19.01.2016, as despite repeated opportunities having been granted, the leave petitioner had not filed a better affidavit in terms of the order dated 01.05.2015. The same was restored on 25.04.2016 and the matter was posted for 11.08.2016, on which date, notice had been issued to the respondent. However, despite a lapse of more than two years, neither the respondent has been served till date nor has anybody appeared today on behalf of the petitioner.

It is 15:52 hours.

In view of the foregoing, the present leave petition is dismissed both for non-prosecution and in default.
