HON'BLE MR. JUSTICE VIBHU BAKHRU

% 06.07.2018 CM No.26036/2018 1.
Allowed, subject to all just exceptions.
W.P.(C) 6854/2018 & CM No.26035/2018 2.
The petitioner has filed the present petition, inter alia, praying as under:- "a) Issue a writ of mandamus or any other appropriate writ, order or direction in the nature thereof directing the Respondent to quantify the final amount payable, by disclosing the amounts due to it in terms of an order dated 20.11.2013 passed by the Airport Director of the Respondent, Mangalore and to settle the dispute pending between the parties."
3.
Mr Rai, the learned counsel appearing for the Airport Authority of India (AAI) states that the amount due to the AAI from the petitioner in
respect of the period September, 2009 to May, 2010, has to be computed by the Airport Director, Trivandrum, who reports to the Regional Executive Director, Southern Region. He submits that, therefore, the present petition should be dismissed and the petitioner ought to be directed to approach the relevant authorities in the State of Kerala.
4.
Whilst Mr Rai may be right that the actual computation may have to be done by a concerned officer who may not be located in Delhi; however, the principal office of the AAI is located in Delhi. Therefore, there should be no impediment for the AAI to ensure that the amount due to it from the petitioner for the occupation of the parking lot at Trivandrum for the period September, 2009 to May, 2010, is communicated to the petitioner. It is so directed.
5.
The calculation of the exact amount payable by the petitioner to the AAI for occupation of the parking lot at the Trivandrum Airport for the period September, 2009 to May, 2010 in terms of the order dated 20.11.2013 passed by the Eviction Officer, Airport Authority of India, Mangalore Airport will be communicated to the petitioner within a period of four weeks from today 6.
The petition is disposed of in the above terms. VIBHU BAKHRU, J JULY 06, 2018 MK
