This petition has been filed by the State challenging the order dated 11th February, 2016, discharging the accused of offences punishable under Section 307 IPC, in FIR 759 /2015.

The perusal of the impugned order would show that as per the record, there was no mark of bullets except on the drawing room door of the complainant. The bullets were fired on the closed door and the complainant was not targetable or visible.

It was, therefore, held that there was only a threat given to the complainant at best, for which the accused have already been charged with i.e. section 336, 440, 384, 506, 34 IPC and section 25, 27, 54, 59 Arms Act. The discharge is only with respect to Section 307 IPC. 4.
The Court find no infirmity, illegality, or impropriety in the impugned order. Petition is dismissed accordingly.
