Learned APP accepts notice on behalf of the State. For the reasons stated in the application the bail application is restored to its original position.

Application is disposed of.

Bail Appl. 1236/2016 The allegations against the petitioner are that one Pawan Kakkar complained that at 7.30 PM on 24th March, 2015 two persons came at his shop along with desi katta and saw (knife) which was hidden in their clothes. They threatened and demanded money. When Pawan Kakkar refused, one person attacked Pawan Kakkar with the butt of the pistol and BAIL APPLN. 1236/2016

one live cartridge fell on the spot. In the meantime, the other person attacked Nishant Saluja who tried to defend himself and got injured on the head. The name of the person apprehended at the spot with the knife was found to be Aditya son of Narender Sharma. The petitioner is the other accused person. The two eye witnesses including the injured witness have already been examined in their chief and have supported the prosecution case. Cross-examination of these witnesses is yet to be conducted. I find no reason to grant bail at this stage. Petition is dismissed. MUKTA GUPTA, J.
