% 18.08.2017 IA No.9112/2017 in REV.PET.289/2017 The present application is premised on the basis that certain facts came to the knowledge of Review Petitioner post rendering the decision on 16.01.2017. This Court is, prima facie, of the view that this is an incorrect statement. The entire issue regarding the connection of the Arbitrator with TNEB was a subject matter of extensive debate and is difficult to accept that the petitioner did not have any knowledge of the facts which are now claimed to have been acquired post rendering the decision. Plainly, it appears this is yet another endeavour on the part of the petitioner to prolong the litigation. The deponent of the affidavit Mr Atul Tripathi and the Managing Director of the petitioner are directed to be

present in the Court on the next date of hearing for further proceedings. List on 21.08.2017.
