% 25.10.2016 IA No.13371/2016 & CS(COMM) 726/2016 This is a joint application filed by the plaintiff and the defendant Nos.1 to 3 under Order XXIII Rule 3 of the CPC, inter alia, praying that the suit be decreed in terms of the prayer clause Nos.58(a), 58(b) and 58(c) of the amended plaint. The learned counsels for the parties state that they have settled their disputes as recorded in paragraph No.2 of the application. The application is duly supported by the affidavits on behalf of both the parties. The agreement is lawful. Accordingly, the application is allowed.

Consequently, the suit of the plaintiff is decreed in terms of paragraph Nos.58(a), 58(b) and 58(c) of the amended plaint. Parties to bear their own costs.

Let a decree sheet be drawn up. The present application shall

form part of the decree.

The suit and all pending applications are disposed of accordingly.
