Counsel for the appellant states that recently, the trial court has passed a final judgment and decree dated 03.02.2017, a copy whereof has been enclosed with CM APPL. 11021/2017.

It is for the appellant to file a fresh appeal assailing the impugned judgment and decree in accordance with law, wherein the grounds taken to assail the preliminary decree shall also be taken. At that stage, this Court will consider disposing of the present appeal. 3.

The applications are disposed of.

At this stage, counsel for the appellant states that the certified copies of the judgment and decree dated 03.02.2017 may be returned by the Registry to enable him to file a fresh appeal. 5.
