O R D E R

% 22.11.2016 On 4th October, 2016, this Court passed the following order:- "Today, learned counsel for the respondents has handed over a status report of the nine refunds claimed by the petitioner. The status report is taken on record. The petitioner is permitted to file a response affidavit, if any, before the next date of hearing. List on 22nd November, 2016."

No response affidavit has been filed by the petitioner till date. Today, an adjournment is sought on behalf of the petitioner on the ground that the main counsel is not available.

Even on the last date of hearing this Court had reluctantly adjourned the matter as it was the case of the respondents that it had processed all the refund claims of the petitioner.

As neither any response has been filed nor the counsel for the petitioner is available, this Court is of the view that the order dated 11th December, 2015 passed in W.P.(C) 11553/2015 stands duly complied with. If the petitioner has any grievance with regard to the decision taken by the respondent regarding refund of claims, it is at liberty to file appropriate proceedings in accordance with law.

With the aforesaid liberty, present contempt petition stands disposed of. The rights and contentions of all parties are left open. MANMOHAN, J NOVEMBER 22, 2016 rn
