There is a misjoinder of cause of action in the instant writ petition because two penalties levied with respect to two charge-sheets have been challenged. There is no commonality in the two charge-sheets. The inter-woven pleadings would render it difficult to treat the instant petition as challenging one penalty and granting right to the petitioner to file a fresh petition to challenge the other. Therefore, counsel seeks leave to withdraw the writ petition with right reserved to file separate writ petitions with respect to penalties which have been levied upon the petitioner. 2.

Granting liberty as prayed for instant writ petition is dismissed as withdrawn.
