% 09.07.2018 The applicant admittedly was a married person on the relevant date of occurrence. As per the school record, the date of birth of the prosecutrix is shown to be 06.07.2000. The FIR was registered on 14.08.2016. In the given fact-situation, the record of panchayat, as relied upon, cannot prima facie be accepted as clinching.
The case involves serious offences punishable under Sections 363/366/376/494 IPC, Section 6 of Protection of Children from Sexual Offences Act, 2012 and Section 9 of Prohibition of Child Marriage Act, 2016.
