The petitioner has filed the petition under Section 11 of the Arbitration and Conciliation Act, 1996 (hereinafter 'the Act'), inter alia, praying for appointment of an Arbitrator for adjudication of the disputes that have arisen between the parties in relation to the agreement dated 03.07.2013.

The learned counsel appearing on behalf of the respondent states at the outset that the respondent has no objection, if an independent Arbitrator is appointed.

The learned counsel for the petitioner submits that prior to the proceeding with the arbitration, the petitioner is desirous of endeavouring to settle the disputes amicably and requests for referring the parties to the Delhi High Court Mediation and Conciliation Centre ARB.P. 381/2016
(DHCMCC).

The learned counsel for the respondent has no objection to the aforesaid course.

In the circumstances, the parties shall appear before the DHCMCC on 02.11.2016 at 03.00PM.

In the event, the parties are unable to resolve their disputes within four weeks thereafter, the parties shall appear before the Coordinator, Delhi International Arbitration Centre (DIAC) on 26.09.2016 at 03:00 PM. It is directed that an Arbitrator be appointed under the Rules of the (DIAC). The arbitration shall be conducted under the aegis of DIAC and in accordance with its Rules. 7.
