The accident dated 08th November, 2001 resulted in the death of Seema. The deceased was aged 14 years at the time of the accident and was survived by her parents, Raja Ram and Munni Devi who filed the claim before the Claims Tribunal. The Claims Tribunal awarded Rs.1,54,500/- to the parents. The appellant challenged the award before this Court in MAC. APP. 694/2007, which was dismissed on 18th May, 2016. 2.

The appellant deposited the entire award amount with UCO Bank, Delhi High Court Branch in terms of the order dated 26th February, 2010 which is lying in fixed deposit and has not yet been released to respondents No.1 and 2.

Respondent No.2 has filed C.M. Appl. 37962/2016 for release of the entire compensation to her on the ground that her husband Raja Ram expired on 13th November, 2012.

The application is allowed and UCO Bank, Delhi High Court Branch

is directed to release Rs.50,000/- to respondent No.2, Munni Devi. The balance award amount lying in the name of Raja Ram and Munni Devi be kept in four fixed deposits of equal amount in the name of Munni Devi for the periods 1 year, 2 years, 3 years and 4 years. 5.

The monthly interest on the FDRs shall be credited to the savings bank account of respondent No.2.

At the time of maturity, the fixed deposit amount shall be credited in the savings bank account of respondent No.2.

All the original FDRs shall be retained by UCO Bank, Delhi High Court Branch. However, the photocopies of the same shall be provided to respondent No.2.

8.

No cheque book or debit card be issued to the claimant/respondent without permission of this Court.

9.

No loan or advance or pre-mature discharge shall be permitted without the permission of this Court.

10.

The claimant/respondent shall approach the UCO Bank, Delhi High Court Branch for completing the formalities for the disbursement of the award amount in terms of this order.

11.

The UCO Bank, Delhi High Court Branch shall ensure that the savings bank account of respondent No.2 is individual savings bank account and not joint account.

12.

The application is disposed of.

Copy of this order be given dasti to learned counsels for the parties under signature of Court Master.
