% 22.07.2016 The order impugned before this Court is order dated 23.02.2016 passed by the Estate Officer under section 5 of the Public Premises (Eviction of Unauthorized Occupants) Act, 1971. At the outset, counsel for the respondent submits that the appeal is maintainable under section 9 of the said Act and therefore, remedy sought in this petition may not lie before this Court.

Learned counsel for the petitioner seeks permission of this Court to withdraw this petition with liberty to execute the remedy under section 9 of the said Act before the concerned Appellate

Authority. Permission granted.
