Notice. Learned proxy counsel for learned Additional Standing Counsel for the State accepts notice. Status report has been handed over which is taken on record.

As per the status report, the family of the petitioner comprising of his parents and two brothers was found residing at C-32, T-Huts, GP Block, Pitampura, Delhi wherein his elder brother Vijay was residing in a separate hut in the same locality. The allegations against the petitioner on which he has been convicted is for offence against the minor daughter of his elder brother however now the wife and daughter of his elder brother are no more residing with elder brother of the petitioner. Though as per the status report, there is no ancestral property which has to be apportioned however the fact remains that the petitioner has to file special leave petition and maintain W.P.(CRL) 1951/2018

social ties. A perusal of the nominal roll reveals that the petitioner has been in continuous custody since 18th October, 2014 and the unexpired portion of his sentence is only around 8 months now. The conduct of the petitioner in jail is satisfactory.

Considering the verification report and the nominal roll of the petitioner, this Court deems it fit to grant parole to the petitioner. It is, therefore, directed that the petitioner be released on parole for a period of 4 weeks on his furnishing a personal bond in the sum of ₹25,000/- with one surety of the like amount to the satisfaction of the learned Trial Court/CMM concerned.

Copy of this order be communicated to the petitioner through Superintendent, Central Jail No.12, Mandoli.
