The present petition by way of Public Interest Litigation has been filed seeking a direction to the respondent to demolish the unauthorized construction in various properties in the Ward No. 89, Sadar Pahar Ganj Zone, New Delhi - 110055.

It is pleaded in the writ petition that despite informing the Authorities regarding the illegal construction vide representation dated 24.05.2016, no action has been taken till date.

The learned counsel appearing for the Petitioner has drawn the attention of the Court to the Annexure P-1 to P-9 and P-11 whereby the Petitioner has annexed the photographs of the alleged unauthorized construction along with the property numbers. 6.

Learned standing counsel for North Delhi Municipal Corporation who appeared on advance notice, on instructions, submits that the complaint of the Petitioner has been received and that appropriate action would be taken in accordance with law.

The writ petition is accordingly disposed of with a direction to the Respondents to consider the allegations made by the Petitioner treating the writ petition as a representation and take appropriate action following due process of law within eight weeks from today, if the allegations are found to be true. The action taken be informed to the petitioner and the petitioner is at liberty to file a fresh writ petition in case necessity thereof arises.
