The petitioner has filed the present petition under Section 11 of the Arbitration and Conciliation Act, 1996, inter alia, praying that the former Judge of this Court appointed by the petitioner as its arbitrator be appointed as a Sole Arbitrator to adjudicate the claims of the petitioner. 2.

The learned counsel appearing for the respondent states that the respondent has no objection if a Sole Arbitrator is appointed to adjudicate the disputes that have arisen in relation to the agreement dated 30.09.2010. However, he submits that the Arbitrator appointed by the petitioner not be appointed as a Sole Arbitrator in this case.

Although the arbitration clause envisages that an Atbitral Tribunal of three arbitrators be constituted, but since the parties are agreeable that the disputes be adjudicated by a Sole Arbitrator; Justice R.V. Easwar (Retired) a

former judge of this court is appointed as a Sole Arbitrator to adjudicate the disputes between the parties.

The arbitration shall be held under the aegis of Delhi International Arbitration Centre (DIAC) and in accordance with its Rules. The parties are directed to appear before the coordinator, DIAC on 20.09.2016 at 10:30 AM.

The petition is disposed of.
