% 09.07.2018 PW-3 Ajit Kumar, brother of the deceased has confirmed his statement under Section 161 Cr.P.C. during the trial. His testimony brings on record, prima facie, oral dying declaration of the deceased, inter alia, as to the involvement of the applicant in the offence of murder. At this stage of the proceedings, it cannot be said that the charges against the applicant are wholly unfounded.
