% 23.08.2016 Present FIR was registered under Sections 406/420 IPC at police station Rajouri Garden on the complaint of respondent no.2. Respondent no.2 alleged in the FIR that he purchased the Innova Car bearing no. DL 7CG 0311 from the petitioner on 10th November, 2014 for `3,45,000/-. When respondent no.2 applied for transfer of registration with the Road Transport Authority, it was revealed that said vehicle was hypothecated with some company. Respondent no.2 alleged that petitioner has cheated him. Petitioner and respondent no.2 have now settled their disputes before the Delhi Mediation Centre, Tis Hazari Courts, Delhi on 19th February, 2016 on the terms and conditions as stipulated in the proceedings of learned Mediator
dated 19th February, 2016, which have been signed by petitioner and respondent no.2.
Respondent no.2 is present in Court and has been identified by SI Aditya PS Rajouri Garden. Respondent no.2 submits that the entire amount in terms of settlement has already been received by him and he is not willing to pursue the FIR any further. Keeping in mind the settlement arrived at between the parties, no fruitful purpose would be served to keep the criminal proceedings pending, more particularly, when the same are commercial in nature. Accordingly, the present FIR No.109/2015 under Sections 406/420 IPC registered at police station Rajouri Garden and the consequent proceedings emanating therefrom are quashed.
Writ petition is disposed of in the above terms. A.K. PATHAK, J.
