In view of the judgment of Hon'ble Supreme Court in the case of Harshad Chiman Lal Modi Vs. DLF Universal and Anr. (2005) 7 SCC 791, it is agreed that the suit as a whole be transferred for decision to the competent Civil Court in the District Gurgaon, State of Haryana.

Accordingly, let suit file be sent by the Registry of this Court directly to the Principal District & Sessions Judge, Gurgaon, State of Haryana and the said District and Sessions Judge will mark the present suit for disposal to a competent court in accordance with law. Before sending the file to the concerned District & Sessions Judge,

Gurgaon, State of Haryana, the Registry of this Court will scan the file for the purpose of record of this Court. 3.
