% 16.08.2018 Learned counsel for the petitioner submits that no allegations of rape have been levelled against the petitioner by the prosecutrix. The only allegation against him is that he along with co-accused Samar and main accused Avneesh had taken the prosecutrix to Noida, where Avneesh kept her in a room. Petitioner used to come to the room some times. I have perused the statement under Section 164 Cr.P.C. of the prosecutrix. Petitioner is in custody for about six months. Keeping in mind the totality of the facts and circumstances of this

case, petitioner is admitted to bail, subject to his furnishing a personal bond in the sum of `20,000/- (Rupees Twenty Thousand Only) with one surety in the like amount to the satisfaction of the trial court. Bail application is disposed of in the above terms. Dasti. A.K. PATHAK, J.
