CM No.3239/2017 This is an application under section 151 CPC for withdrawal of the petition in view of the settlement between the parties dated 19.1.2017, copy of which is placed on record as Annexure A to the present application. Learned counsel appearing for the respondent has today in court handed over to the petitioner a Banker's cheque dated 23.01.2017 bearing No.987550 for a sum of Rs.40 lakhs of Bank of India, Asaf Ali Road, New Delhi favouring the petitioner Shri Mohan Nair, who is present in court today and is identified by his counsel and has accepted the said banker's cheque. He submits that he will take steps on the basis of this cheque as per terms of the compromise.
Learned counsel for the parties submit that the parties shall abide by the terms and conditions of the compromise deed dated 19.1.2017. Application is allowed.
