O R D E R

% 09.07.2018 Petitioners (accused) and respondent no. 3 (complainant) are related to each other. Disputes arose with regard to the immovable property. It is submitted that names of respondent nos. 4 and 5 have been kept in column no. 12 in the charge-sheet. It is submitted that petitioners and respondent nos. 3 to 5 have settled their disputes amicably, vide a Memorandum of Understanding dated 2nd May, 2018; therefore, FIR No. 221/2011 under Sections 420/467/468/471/120-B IPC registered at Police Station Rajouri

Garden and the consequent proceedings emanating therefrom may be quashed.

Respondent nos.3 to 5 are present in Court alongwith their respective counsel and admit having settled the matter with the petitioners, of their own free will and without any undue force, pressure or coercion. Petitioners have paid `12,00,000/- to respondent no. 3 (complainant); whereas `6,00,000/- each to respondent nos. 4 and 5, vide three demand drafts, photocopies whereof have already been placed on record. Keeping in mind the settlement arrived at between the petitioners and respondent nos. 3 to 5 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti.
