% 21.08.2018 Notice. Learned APP accepts notice for respondent no.1. Respondent no.2-Ms. Jagjeet Kaur is present in Court along with her counsel, who accepts notice. She has been identified by W/ASI Roshini Sharma of police station Crime (Women) Cell, Nanak Pura.
Respondent no.2 submits that she has settled the matter with petitioner no.1 of her own free will and without any undue force, pressure or coercion before the Delhi High Court Mediation & Conciliation Centre on 23rd April, 2018.
Her marriage with petitioner no.1 has already been dissolved by a decree of divorce by mutual consent passed by the Family
Court, South District, Saket Court, New Delhi on 9th August, 2018. She further submits that she has received entire settled amount of ₹10.65 lacs from petitioner no.1 and has no objection in case FIR No. 112/2017 under Sections 498A/34 IPC registered at police station Crime (Women) Cell, Nanak Pura is quashed against petitioner no.1 and his relatives, that is, petitioner nos. 2 and 3.
Keeping in mind the settlement arrived at between the petitioner no.1 and respondent no.2 voluntarily, in my view, no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR, which is at the investigation stage, is quashed.
Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
