The application is disposed of.

CM(M) 832/2016 By the present petition, the petitioner seeks expeditious disposal of the leave to defend application filed by the respondent/defendant in the suit filed of the petitioner. The petitioner has filed a summary suit for recovery of Rs.11 lacs. It is the grievance of the petitioner that though the suit is filed in and the leave to defend application was also filed in September/October 2014, the same has not been disposed of for one reason CM(M) 832/2016

or the other. He relies on various orders to contend that the respondent have been taking adjournments.

The matter is now fixed before the trial court on 18.10.2016. In the facts and circumstances of the case, it would be appropriate that the trial court expeditiously disposes of this application and no adjournment should be given to either of the parties in case the same is sought. The petition stands disposed of.
