% 16.03.2016 IA 3485/2016 This is an application filed by the plaintiff for refund of court fees under Section 16A of the Court Fees Act.

I note that the suit was decreed on January 21, 2015 pursuant to application filed by the parties under Order 23 Rule 3 CPC before recording of evidence on merits of the claim. Accordingly, the plaintiff is entitled to refund of court fees under Section 16A of the Court Fees Act. The application is disposed of.
