The appellant's counsel has relied upon the explanation of Fundamental Rule 26 - FSSR and states that by virtue of Section 10 of the Delhi School Education Act, the norms contained in the said Rule would apply. This is in furtherance of the contention that the respondent is disentitled to increments for the period she was in gainful employment i.e. 19.01.2008 to 21.09.2010. Learned counsel for the respondent seeks some time to consider the question and make

submissions.

It is open to the respondent to encash the cheque without prejudice to her rights.
