Learned counsel for the respondent raises an objection to the maintainability of the present petition on the ground that no part of the cause of action has arises in Delhi. He states that the petitioner is based in District Baghpat, U.P. and posted at Malegaon, Calcutta in the North Eastern Railways Zone. He further submits that even the representations that have been placed before this Court by the learned counsel for the petitioner reveals that they have been submitted to the Chief Security Commissioner, Railway Protection Force, Malegaon. 2.
On confronting learned counsel for the petitioner with the aforesaid objections, she concedes that no order has been passed W.P.(C) 7094/2018
by any authority in Delhi for vesting jurisdiction in this Court. That being the position, we decline to entertain the present petition, which is accordingly dismissed along with the pending application with liberty granted to the petitioner to approach the competent Court vested with the territorial jurisdiction for relief.
