1. The affidavit of service filed by the Petitioner reveals that the Respondent has been served by hand.
2. None appears for the Respondent. The Respondent is accordingly set ex parte.
3. The averments in the petition to the effect that there is an arbitration clause in the agreement to sell dated 29th September 2013 and that the Petitioner has invoked it by sending a legal demand notice to the Respondent on 18th October 2013 remain uncontroverted.
4. The Court, accordingly, appoints Justice P.K. Bhasin, a former Judge of this Court, (Mobile No.9871300032) as sole Arbitrator to adjudicate the disputes between the parties including their claims and counterARB.P. 560/2016
claims. The arbitration shall take place under the aegis of the Delhi International Arbitration Centre ('DAC'). The fees of the learned Arbitrator will be in terms of the Delhi High Court Arbitration Centre (Arbitrators' Fees) Rules.
5. The petition and the applications are disposed of. A copy of this order be communicated to Justice Bhasin as well as Additional Coordinator, DAC forthwith.
