(ORAL) Quashing of FIR No. 332/2017, under Section 420 IPC, registered at police station Patel Nagar, New Delhi is sought by petitioners on the basis of affidavit of 26th May, 2018 (Annexure- P4 colly) of respondent No.2.
Learned Additional Public Prosecutor for respondent-State has placed on record status report and submits that due to inadvertence, Crl.M.C. number has been mentioned as 3591/2018 in the status report, whereas it has to be W.P.(Crl.) 3591/2018.
Be that as it may. Perusal of the aforesaid status report reveals that another victim-Amit Singhal, s/o Shri Bhagwan Singh, has also filed a Crl.M.C. 3443/2018
complaint alleging that he has been cheated by petitioner-company. Investigating Officer of this case submits investigation qua said complaint is in progress. Petitioners' counsel pleads ignorance about it. Learned Additional Public Prosecutor for respondent-State submits that connected petition W.P(Crl.) 3591/2018 has been disposed of while taking note of the fact that aforesaid Amit Singhal has been added as one of the victims in this FIR case. Learned Additional Public Prosecutor for respondent-State further submits that in view of settlement between petitioners and respondent No.2-Ram Singh Agarwal, no further proceedings are to be taken.
In view of above, while taking on record that the dispute between petitioners and respondent No.2- Ram Singh Agarwal already stands resolved, this petition is disposed of with liberty to petitioner to file a fresh petition as and when dispute with victim Amit Singhal is resolved.
