% 19.10.2016 Learned counsel for petitioner submits that petitioner is in judicial custody for the last four years.
All the public witnesses have been examined including the eye witnesses. None of the public witnesses have supported the prosecution case.
Eye witnesses have failed to identify the petitioner. Co-accused Jaswinder @ Sunny, juvenile has already been acquitted by the Juvenile Justice Board on 15th October, 2015. Remaining witnesses are police witnesses.
Learned additional public prosecutor has opposed the bail application. He has contended that even though the public witnesses have not identified the petitioner but blood stained knife was recovered from the petitioner
pursuant to the disclosure statement made by the petitioner. Petitioner had stabbed the deceased while co-accused had caught hold of him. Allegations against the petitioner are serious in nature. Keeping in mind the totality of facts and circumstances, petitioner is admitted to bail upon his furnishing a personal bond in the sum of `25,000/- (Rupees Twenty Five Thousand only) with one surety of the like amount to the satisfaction of trial court.
Bail application is disposed of in the above terms. A.K. PATHAK, J.
