% 20.06.2016 Petitioner has filed the present writ petition for the issuance of a writ of certiorari or any other appropriate writ, order or direction quashing of impugned letter no.NHAI/RJ/11019/EPC/2011/BBJ/850 DATED 31.5.2016 issued by the respondent.
On the last date of hearing, notice was issued. A direction was issued to the respondent to open financial bids as scheduled on 14th June, 2016. A direction was also issued to open the financial bid of the petitioner, however, the same was not processed till the next date of hearing. Counter affidavit has been filed wherein it has been stated that petitioner is L-8.
Counsel for the petitioner submits that he has instructions not to press this writ petition. However, he submits that the issues raised by the petitioner with regard to bid capacity criteria should be kept open. Counsel for the respondent submits that petitioner cannot be allowed to raise this issue with respect to
subject matter of the writ petition.
Counsel for the petitioner submits that as far as the present writ petition is concerned, he would not raise any grievance but for any future tender in which he may participate, he may be permitted to raise the question with regard to bid capacity criteria.
Since we have not heard the matter on merits, the issue regarding bid capacity criteria is kept open along with the objections raised by the respondent with respect to the bid capacity criteria.
Petition stands dismissed as withdrawn.
