The petitioner, by this petition, under Article 227 of the Constitution of India, though seeks expeditious disposal of H.M.A. Petition No.838/2014, pending before the Court of the Principal Judge, Family Court, Saket (South East) but has not placed any material before this Court to show that the delay alleged in disposal of the petition is not on part of the petitioner herself. 4.

In the absence of the same, the petitioner cannot be given precedence over the others whose disputes of the same vintage may be pending before the Family Court.

Counsel for the petitioner then states that there is no Presiding Officer of the Court for some months.

It is to my knowledge that appointment to the said Court has now been made. Thus, the said cause of action if any has now disappeared.

The petition is disposed of with a direction that subject to the petitioner herself not taking any adjournments, the Principal Judge, Family Court, Saket (South East) may proceed with H.M.A. No.838/2014 titled Swati Agarwal Vs. Manish Mishra as expeditiously as possible, having regard to the nature of cruelty alleged by the petitioner and not allow the respondent to cause any delay or take adjournments in the proceedings. 8.

No costs.
