OMP (I) (COMM)No. 261/2016 Learned ASG appearing on behalf of respondents states that as of now, no decision has been taken to invoke the bank guarantee. Learned counsel for the petitioner, in view of the statement made by the learned ASG, seeks permission to withdraw the petition. However, he submits that the petitioner would like to approach the respondent for a discussion in terms of the letter dated 28.05.2016 of the respondent, but without signing the copy of the Amendment No. 1 to the
contract as it is contended that the proposed amendment itself would be subject of the discussion.
