Possession of the subject premises was restored to the respondent way back in the year 2018. The matter has come before me for the first time. Learned counsel for petitioner seeks pass over to obtain instructions if petitioner wants to withdraw this petition with liberty to institute fresh Civil proceedings against the present respondent.

As recorded in pre-lunch sessions, possession of the subject premises stood restored to the respondent/landlord in execution proceedings way back in the year 2018. In view of judicial precedents in cases titled: Smt. Poonam Bangia vs Harbhagwan Dass Chandiramani in RC. REV. 16/2021 & CM. APPL. 2959/2021; N.C. Daga vs Inder Mohan Singh Rana in Appeal (civil) 831/2003; Vinod Kumar Verma vs Manmohan Verma & Anr. in Civil Appeal Nos. 5220-5221/2008 and L.S. Shanmuga Sundaram vs P. Kunji Mohideen Kutty Haji in C.R.P. (NPD) No. 157/ and C.M.P No. 7932/2022, the petition is dismissed as infructuous. Accordingly, all pending applications stand disposed of.
